Reporting and redress procedure for illegal content (English)

Reporting and redress procedure for illegal content

We provide a contact form that can be used to report illegal content. This form includes fields for the following content:
  • reason for the illegal content;
  • storage location (e.g. URL); and
  • name.

However, these are not mandatory fields and the notification can also be sent without stating a reason, for example.

If the reporting party provides contact details, we will send a confirmation of receipt. The report will be processed promptly and the person making the report will be informed of our decision without delay.

The contact form can be accessed here: https://cetl.lu/en/contact.html

Reasons for restrictions

We not only have to inform the reporting person, but also the reported person. For example, if we delete a user's content following a report, we must send the person concerned a clear and specific justification (including the type of restriction and the basis for the decision).

Obligation to report certain criminal offenses

We are obliged to inform the law enforcement or judicial authorities immediately in the event of suspected criminal offenses that pose a risk to the life or safety of a person.

However, there is no general obligation for us to regularly search for illegal content (so-called monitoring obligation). We are therefore not liable if we have no knowledge of illegal content. We act actively when we:
  • receive a report;
  • become aware of a criminal offense that poses a threat to the life or safety of a person and must immediately report it to the authorities.
